Data retention

Our policy on retaining your personal data.

The Company will retain your personal data only for as long as is necessary. Different laws require us to keep different data for different periods of time.

The Conduct of Employment Agencies and Employment Businesses Regulations 2003, require us to keep work-seeker records for at least one year from (a) the date of their creation or (b) after the date on which we last provide you with work-finding services.

We must also keep your payroll records, holiday pay, sick pay and pensions auto-enrolment records for as long as is legally required by HMRC and associated national minimum wage, social security and tax legislation.

Where the Company has obtained your consent to process your personal and/or sensitive personal data, we will do so in line with our retention policy. This states that this data will be kept for 2 years, then upon expiry of that period the Company will seek further consent from you. Where consent is not granted the Company will cease to process your personal and/or sensitive personal data.

Here’s a note of some of the personal data that we hold and for how long we keep it:

DBS certificate

Certain Clients require The Company to carry out DBS checks on candidates to ensure compliance with their processes. These will be kept for 6 years by The Company, and the Client may have their own separate retention period. You will be informed in a DBS check is required.

Records of criminal convictions

Deleted as soon as the conviction is spent, unless working in an exempt profession.

Death benefit nomination and revocation forms

During employment (and if any payments are made, six years after the last payment of benefit)

IP addresses, internet usage history, recorded calls and location data from company equipment

CCTV:

The CCTV in The Company's Nottingham office is governed by the Exeid (The Property Management Company) CCTV policy, a copy of which can be made available to you on request.

In summary the policy states that images will be kept by Exeid for 1 month, unless a crime is being investigated, in which case they may be kept for longer.
